Advertising & Promotions Policy
Effective May 2010
Defying Disaster’s™ mission is to provide you with relevant information to minimize threats to your health and safety in situations ranging from crime to disasters, including risks from infectious diseases. We accept advertising on the site to support our mission. This policy has been established by Defying Disaster™ to govern advertising on its website, including Defying Disaster’s™ acceptance of advertisements and how advertisements are displayed on and removed from the Defying Disaster™ site. For these purposes, “Advertising and Advertisements” mean all forms of advertising and sponsorships for which Defying Disaster™ receives compensation, including banner, badge, and contextual advertising, sponsored content, and promotions.
- Defying Disaster™ has sole discretion to determine the types of Advertising that will be accepted and displayed on the Defying Disaster™ site. Defying Disaster™ does not review or endorse any products or services that are advertised on its sites. In no event shall Defying Disaster’s™ acceptance of any Advertisement be considered an endorsement of the product or service advertised or for the company that manufactures, distributes, or promotes such product or service.
- Defying Disaster™ will not accept Advertising that, in Defying Disaster’s™ opinion, is not factually accurate. In addition, Advertising must not contain false or misleading claims, or offensive material, including material that misrepresents, denigrates, ridicules, or attacks an individual or group on the basis of age, color, national origin, race, religion, sex, gender, marital status, sexual orientation, handicap, or any other status deemed inappropriate by Defying Disaster. Advertising must not be fraudulent, deceptive, illicit, misleading or offensive.
- Defying Disaster™ will not accept Advertising related to any of the following: alcohol, firearms, ammunition, fireworks, gambling, pornography, tobacco, the simulation of news or an emergency event, or material that directly advertises products to or is intended to attract children
- Advertising also must not promote products that are illegal or whose distribution would violate the law, advocate a political, religious or controversial public position or candidate for public office, make health claims that are not adequately substantiated or that promote illegal or objectionable products. Other Advertising that will not be accepted include: media or messages for or that reference “M” rated video games; content that is unreasonable, unlikely or that makes extraordinary product or service claims; media messages or imagery that strobe or flash; media or messages that contain unsubstantiated “miracle” weight loss or other miracle claims of cure; advertising units that extend beyond the defined advertising space or interfere with the content or impact the readability of the content without user initiation; advertising units that do not retract to the defined advertising space upon user scroll off or contain a “close” or “X” for user to retract or close the ad unit/message after user initiation;advertising units that mimic computer functions or deceptively indicate a computer or other function that would be reasonable to the average user to assume as a reason to click the unit
- Defying Disaster™ maintains a distinct separation between Advertising and editorial content. All advertising and promotion on Defying Disaster™ sites shall be clearly and unambiguously identified as such, and Defying Disaster™ will not accept any Advertising on the Defying Disaster™ site that is not so identified. Clicking on the ad will link to an advertiser’s site. Defying Disaster™ is not responsible for the content on the advertiser’s site.
- From time to time, Defying Disaster™ may create special advertorial sections of its websites, consisting of content from its advertisers. Content that is created, provided or influenced by an advertiser on any Defying Disaster™ site is clearly and unambiguously identified as “From Our Sponsor” or “Provided By” the advertiser. Such advertiser content is not subject to editorial review by Defying Disaster™. Any content in these areas that Defying Disaster™ provides is clearly identified as such and is created and editorially reviewed by Defying Disaster™ and is not reviewed or influenced by advertisers.
- From time to time, Defying Disaster’s™ advertisers contract with it to sponsor certain targeted sections of its websites. Content in such sections will be labeled as “Brought to You By” or “Funded By” the advertiser. Such content is created and editorially reviewed by Defying Disaster™ and is not reviewed or influenced by advertisers. Such sponsored pages are clearly and unambiguously identified as such.
- Defying Disaster™ reserves the right to reject, cancel, or remove at any time any Advertising from the Defying Disaster™ Site for any reason and will provide prompt notice to the advertiser upon rejection, cancellation, or removal of any Advertising. Defying Disaster™ also reserves the right to determine the appropriate placement of the Advertising on the Defying Disaster™ sites.
- It is the responsibility of the Advertiser to comply with all applicable domestic and foreign laws, including pharmaceutical advertising that must be in compliance with FDA guidelines for Direct to Physician (DTP) and Direct to Consumer (DTC) advertising as well as underwritten CME programs that must be labeled in accordance with the guidelines of the Accrediting Council for Continuing Medical Education (ACCME) and any other relevant accrediting bodies. Defying Disaster™ assumes no obligation to monitor its advertisers’ compliance with applicable laws and regulations; however, if Defying Disaster™ becomes aware of any breach or potential breach of any applicable law or regulation or of these guidelines, Defying Disaster™ may remove the Advertising.
- Advertisers must only offer products or services, which are readily available for purchase at the advertised price (with noted tax and delivery fees). The Advertising must also clearly identify the advertiser. Any Advertising that could be misconstrued as editorial content will be clearly labeled as Advertising.
- No Advertising shall be permitted which may injure the good name or reputation of Defying Disaster™, GermTheory LLC or Defying Disaster™ sites.
- Defying Disaster™ has sole discretion with respect to interpretation of this policy and all other issues associated with Advertising on Defying Disaster™ Web sites. Defying Disaster™ may change this policy at any time in its sole discretion. If Defying Disaster™ makes changes to this policy, the updates will be posted here. This policy’s effective date will be identified at the top of the page.
